These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and offerings, including but not limited to online and in-person pole dance and fitness classes, group workshops, and any associated content or communications (collectively, the “Services”).

By accessing or using our website or Services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Services.

1. Eligibility

To use our Services, you must:

• Be at least 18 years old or have the express consent of a legal guardian.

• Be physically able to participate in fitness activities.

• Accept full responsibility for your own health and safety.

You acknowledge that participation in physical activity such as pole dance and fitness may involve inherent risks, including injury, and you voluntarily assume all such risks.

2. Services Provided

JessicaMarsh.net offers:

• Online pre-recorded and live-streamed pole dance and fitness classes.

• In-person instruction at various locations.

• Group workshops, intensives, and special events.

• Downloadable training resources and guides.

Services may be subject to availability and change without notice.

3. Booking, Payments, and Refunds

• All prices are listed in Canadian Dollars (CAD).

• Payments for classes, memberships, or workshops are due in full at the time of booking.

• We accept payments via secure third-party processors.

• All sales are final. We do not issue refunds except where required by law or at our sole discretion.

• Missed sessions are non-transferable and non-refundable.

4. Waiver and Release of Liability

Participation in our Services requires the execution of a waiver releasing Jessica Marsh and any affiliated instructors or entities from liability for injury, loss, or damages.

You understand and acknowledge:

• You are solely responsible for your health and well-being during participation.

• It is your responsibility to consult a physician before beginning any fitness program.

• You release us from any and all claims arising out of your participation.

You must download, complete, and submit the waiver before participating in any in-person or online class or workshop.

5. Intellectual Property

All content on JessicaMarsh.net, including but not limited to videos, text, images, logos, and training materials, is the intellectual property of Jessica Marsh and is protected by Canadian copyright and trademark laws.

You agree not to:

• Copy, reproduce, distribute, or publicly display any content without express written permission.

• Share login credentials or recorded content with others.

Violation of this clause may result in account termination and legal action.

6. User Conduct

You agree to use our Services in a respectful and lawful manner. You may not:

• Harass, abuse, or harm other users or instructors.

• Use our Services for any unlawful or unauthorized purpose.

• Post or transmit harmful or offensive content.

We reserve the right to suspend or terminate your access if you violate these rules.

7. Health and Safety Disclaimer

Our Services are not a substitute for medical advice. Always consult your physician or healthcare provider before starting a new fitness routine. You participate at your own risk and are responsible for your own safety during classes.

8. Modifications

We reserve the right to update or change these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the Services after changes constitutes your acceptance of the revised Terms.

9. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages.

• Our total liability for any claims arising under these Terms is limited to the amount you paid us for the Services in the preceding 3 months.

These Terms shall be governed by the laws of the Province of Manitoba and the laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Winnipeg, Manitoba.
